These terms and conditions are valid from the 1rst of July 2022. 

Preamble

This site in its entirety, including all rights pertaining thereto, is the property of Tilburg Robotics. Reproduction in whole or in part of the site is strictly prohibited without the prior consent of its owners. However, hypertext links to the site are authorized and do not require prior approval.

1. Acceptance of Terms and Conditions

The customer duly acknowledges having read the special conditions of sale set out on this screen at the time of placing an order, and expressly accepts these conditions of sale without reservation. These terms and conditions of sale govern the contractual relationship between Tilburg Robotics and the customer and are accepted unreservedly by both parties. These terms and conditions of sale will take precedence over any other conditions appearing in any other document unless a prior, express and written exemption has been established.

2. Products

The Tilburg Hand is a low-volume product, and is usually built on order. As such, it takes up to one month after the order is placed for the product to be shipped.

3. Order

The preferred method of placing an order is through the pre-order inquiry button on the main website. After submission of the form, Tilburg Robotics will contact the customers to discuss customizations, country-specific regulations and method of payment, and to send an order invoice. The order is complete on receipt of payment. Cancellation of orders is possible at any time prior to shipping, but costs that have already been incurred for the manufacturing of the products may be detracted from the refund.

4. Delivery

Once the order has been confirmed, Tilburg Robotics undertakes to manufacture and deliver all the items ordered by the buyer to its carrier. For its part, the carrier is bound by contract with Tilburg Roboticss to deliver the order to the buyer’s address as provided by Tilburg Robotics. Orders within the European Union are inclusive of value added tax and shipping costs. For deliveries outside the European Union, the customer undertakes to pay all import taxes due on products, as well as customs duties, value added tax and any other taxes payable pursuant to the laws of the country to which the order is to be dispatched. Tilburg Robotics will not be held liable for the non-payment of taxes by the customer.

Tilburg Robotics can deliver its products to most countries, but restrictions may apply and will be evaluated on a case-by-case basis.

The customer is advised to systematically check parcels upon delivery, and to refuse any damaged parcels. Missing or damaged items must be reported by the customer to the carrier within 48 hours of delivery.

5. Payment

The price charged to the customer is the price quoted on the order invoice sent to the customer by Tilburg Robotics. The preferred method of payment is by bank transfer, but credit card, cheque, or alternative methods are possible, too.
Once validated by the customer, the order will be considered effective only once the bank has approved payment. If payment is refused, the order will be automatically cancelled and the customer notified by e-mail. Furthermore, Tilburg Robotics reserves the right to refuse any order from a customer with whom it is in dispute.

7. Disputes

This contract is subject to Dutch law. Tilburg Robotics cannot be held liable for any tangible or intangible damages or bodily injury that may result from the malfunction or improper use of the products sold, or that might result from any possible changes made to the products by their manufacturers.

In the event of disputes arising from the implementation of this contract, the buyer may, before undertaking any legal action, seek an amicable solution and call upon assistance from an industry trade association, a consumer association or any other advisory body of his choice. It is understood that the search for an amicable solution does not in any way affect either the warranty or statutory limitation period. In general, and subject to the discretion of the Courts, compliance with the provisions of this contract relative to the contractual warranty supposes that the buyer honours his financial commitments towards the seller.
Favourable consideration will always be given to any complaints or disputes, as it is always assumed that customers taking the trouble to expose their situation are acting in good faith. In the event of a dispute, the customer should first contact Tilburg Robotics to reach an amicable solution.

8. Warranty

In no event may Tilburg Robotics be held liable for non-compliance with the regulations and laws in force in the country to which products are to be dispatched.
In all events, the customer benefits from the statutory warranty covering third-party rights and hidden defects. Should the buyer prove the existence of a hidden defect, the seller is legally bound to compensate for all consequences. If the buyer institutes legal proceedings, he must do so within a “short period” of discovering the hidden defect. 9. Governing Language

The governing language of these terms and conditions of sale is English.

10. Legal Information

The collection of personal data for the purposes of distance sales is mandatory. This information is indispensable for the processing and routing of orders, and the issue of invoices and warranty contracts. Orders cannot be confirmed without this information. Customers are entitled to access, modify, rectify and delete their personal data, and may exercise this right with regard to Tilburg Robotics.
